The "awarding agency official" is the Grants Officer at the installation which made the award, unless otherwise specified. Requests for "approval by the awarding agency" or for "prior approval" shall be directed to the Grants Officer. The name of the assigned NASA Technical Officer appears on the face of each award. The "FMO" is the Financial Management Office at the installation which made the award. Recipient Responsibilities and Federal Requirements The requirements of this award in all instances supersede the requirements in "NASA Provisions for Research Grants and Cooperative Agreements" (NASA Form 1463A or equivalent). The following Special Conditions, to the extent they may be appended to individual award documents, do not apply to FDP awards as their substance is included in the FDP General Terms and Conditions or the NASA Agency-Specific Requirements: "Program Income," "Interest Bearing Accounts," "Elimination of Unnecessary Burden," "Debarment and Suspension," "Debarment and Suspension and Drug-Free Workplace," "Patent Rights--Correct Citations," "New Restrictions on Lobbying," and "Federal Contribution to Procurements." Article 4. Payment The FMO will specify payment method and provide procedural instructions. Article 6. Non-Competitive or Continuation Award Requirements Multiple Year Grants. If an award contains a "Multiple Year Grant" special condition, FDP Article 6 applies in its entirety. For these awards, "Project period" means the period from the initial award date to the end of the last year of anticipated support. Submission. The grantee shall submit an annual performance report by the end of the tenth month after the anniversary date of the award, distributed as follows: a. Original - Grants Officer. b. Copy - NASA Technical Officer. c. Microreproducible copy - CASI. Article 7. Financial Reports Paragraph (a) does not apply to NASA. Submit SF 272 to the FMO. Article 8. Final Report Requirements A summary of research shall be submitted upon termination of support under a specific grant, whether or not support is continued under another grant number, and distributed the same as performance reports under Article 6. The summary of research is intended to summarize the entire research accomplished during the duration of the grant. Cumulated bibliographic references to, or abstracts of, all publications issued during the course of the research shall be included. Article 9. Dissemination of Project Results If dissemination as a NASA scientific or technical publication is desired, the request accompanied by a draft manuscript should be sent to the Scientific and Technical Information Division (Code JTT), National Aeronautics and Space Administration, Washington, DC 20546, which will provide further instructions. Article 14. Extensions Without Additional Funds "Single extension" means that only one extension may be made to the basic award, or per subsequent supplement. Article 15. Equipment and Real Property Grants funds shall not be used to procure passenger carrying vehicles. The annual inventory of government-owned property required by OMB Circular A-110 shall be prepared as of June 30 and submitted to the Grants Officer by July 31. Prior approval is required for acquisition of single items of property which cost in excess of $25,000 and were not included in the proposed budget. Any acquired single items of property, costing in excess of $5,000, which were not listed in a proposed budget, shall be listed in the next renewal proposal (or, in the absence of a proposal, in a letter to the Grants Officer due by the award ending date). Article 21. Unobligated Balances and Limit of Federal Liability Paragraph (b) does not apply to NASA. If uncommitted carry over funds are likely to be substantial, the estimated amount shall be included in any continuation proposal. Article 22. Patents and Inventions The NASA regulation applicable to paragraph (e)(2) of the clause is at 14 CFR 1245.2, Licensing of NASA Inventions, paragraph 1245.210. The following item is added to paragraph (f) of the clause: (5) The Grantee shall include a list of all Subject Inventions required to be disclosed during the preceding year in the performance report, technical report, or renewal proposal, and a complete list (or a negative statement) for the entire award period shall be included in the summary of research. The NASA implementing regulations for paragraph (g)(2) of the clause is at 48 CFR 1827.373(b)(NASA FAR Supplement paragraph 18-27.373(b)). The following requirement constitutes paragraph (l) of the clause: (l) Communications. A copy of all submissions or requests required by this clause, plus a copy of any reports, manuscripts, publications or similar material bearing on patent matters, shall be sent to the installation Patent Counsel in addition to any other submission requirements in the Grant provisions. If any reports contain information describing a subject invention for which the Grantee has elected or may elect title, NASA will use reasonable efforts to delay public release by NASA or publication by NASA in a NASA technical series, for six months from the date of receipt, in order for a patent application to be filed, provided that the Grantee identify the information and the subject invention to which it relates at the time of submittal. If required by the Grants Officer, the Grantee shall provide the filing date, serial number and title, a copy of the patent application, and a patent number and issue date for any subject invention in any country in which the Grantee has applied for patents. Article 25. National Security Initial submission of information (subparagraph d(1)) shall be only to the NASA Grants Officer. Article 26. Nondiscrimination NASA's implementing regulations appear at 14 CFR Parts 1250, 1251, and 1252. Article 27. Animal Welfare Requirements established by NASA appear at 14 CFR Part 1232. Article 30. Human Subjects Agency requirements are contained in NASA Management Instruction (NMI) 7100.8, "Protection of Human Research Subjects." Debarred or Suspended Parties NASA's debarment and suspension and drug-free workplace regulations appear at 14 CFR Part 1265. Statutory Article 1. Consultants Payments to individuals for consultant services under a NASA Grant or Cooperative Agreement shall not exceed the daily equivalent of the maximum rate paid to a GS-18 Federal employee. The limit applies to personal compensation exclusive of expenses and indirect cost. (Effective January 10, 1993, the limit is $443 per day.) Statutory Article 2.
