Number: 98-218 Title: VERTICAL MAXIMUM PRICE FIXING: STATE OIL V. KHAN Authors: Michael V. Seitzinger, American Law Division Abstract: Respondent Khan and his corporation entered into an agreement with petitioner State Oil to lease and operate a gas station owned by State Oil. Respondents agreed to obtain the station's gasoline supply from State Oil at a price equal to a suggested retail price set by State Oil. The Supreme Court granted certiorari to consider whether State Oil's conduct constituted a per se violation of the Sherman Act. The Court held that State Oil's conduct did not constitute a per se violation, thereby overruling an earlier Supreme Court case. Pages: 3 Date: Updated March 5, 1998
