When designing a file transfer protocol, it seems to me it makes sense to do what the orginal design for uucp detailed - namely all protocols should start out the same. The file transfer programs should then have a way of communicating to eachother what protocols they can use, and chosing one they have in common. I don't have all the detail on the DOD TCP protocol, but I hope it does this.
