The lawsuit filed in Las Vegas seeks to "put to rest the idea that any county has the RIGHT to enact LAWS to override the Constitution, " John Schmidt, associate U.S. attorney general, said in a telephone interview from Washington. Schmidt said the suit was filed against officials of Nye County, which covers a vast tract of south-central Nevada, because federal workers there had been THREATENED and INTIMIDATED by county officials. At issue is the so-called County Supremacy Movement, or Sagebrush Rebellion II, in which local governments assert OWNERSHIP over federal lands. In Nevada, 87 percent of the land is claimed or managed by the federal government; Nye County, Nevada's largest, includes much of Nellis Air Force Base and all of the Nevada Test Site. The original Sagebrush Rebellion involved mostly state-level protests of federal ownership in the 1970s. In the NEW MOVEMENT, officials of 35 counties in Nevada, California, New Mexico, Idaho and Oregon have PASSED MEASURES claiming the RIGHT to federally administered land. In most cases, "NOTHING HAS HAPPENED beyond the county commission enacting an ordinance, then going out to dinner," Schmidt said. But in Nye County, federal officials said, local officials sent a bulldozer to do road construction in the Toiyabe National Forest and THREATENED federal workers with LEGAL ACTION if they continued to oversee federal land. The county passed a resolution in 1993 CLAIMING Nevada, not the United States, owns national forests and other lands, giving Nye officials the authority to manage the lands. A later resolution claimed OWNERSHIP of virtually every road on federal lands within the county. Rachel Nicholson, Nye County deputy district attorney, said the county resolutions carry no weight of law. And she said they are not aimed at any land on the huge Nellis bombing range or the Nevada Test Site, where nuclear weapons have been tested. The FEDERAL lawsuit seeks to STRIKE DOWN the two resolutions as violations of the U.S. Constitution, and also seeks a permanent injunction preventing their implementation. Nye County Commissioner Dick Carver, a leader in the "County Supremacy Movement," said he WELCOMED the lawsuit. "This will bring it to a head," Carver said.
